Terms of Service

These terms govern your use of the Flagchase app. The full terms below are provided in English.

1. Acceptance of terms

Flagchase is provided by Eksire (“we”, “us”). By creating an account or using the Flagchase app, you agree to these Terms of Service. If you do not agree, please do not use the app.

2. Use at your own risk

Flagchase involves physical outdoor activity — running, often in terrain, parks, and forests. You participate entirely at your own risk. You are responsible for assessing your own fitness, the conditions, the terrain, and traffic, and for complying with local rules and respecting private property. Eksire is not responsible for injuries, accidents, or losses arising from your use of the app or participation in any run. Stay aware of your surroundings and do not look at your phone while moving in hazardous areas.

3. Fair play

Leaderboards only work when everyone plays fair. You agree not to cheat, including but not limited to: tampering with, cloning, relocating, or damaging NFC checkpoint tags; spoofing GPS locations; scanning checkpoints by any means other than physically visiting them; or manipulating run data. We may invalidate runs, remove leaderboard entries, and suspend or terminate accounts involved in cheating.

4. User content

You may create and publish routes in Flagchase. You retain ownership of routes you create, but grant Eksire a worldwide, non-exclusive, royalty-free license to host, display, and distribute them within the service so other users can discover and run them. You are responsible for ensuring that routes you publish are safe and lawful — including having any necessary permission to place physical checkpoint tags. We may remove content that is unsafe, unlawful, or violates these terms.

5. Checkpoint tags and land access

If you create routes, you are responsible for the physical NFC checkpoint tags you place. This includes obtaining any necessary permission from landowners or authorities before placing tags, and complying with local laws and regulations. In Norway, the right to roam (allemannsretten) allows access to open country, but it does not grant a right to install fixed objects — respect private property, cultivated land, and protected areas, and remove your tags if a route is retired. Eksire is not responsible for tags placed by users.

6. Disclaimer of warranties and limitation of liability

Flagchase is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of GPS or timing data, or uninterrupted availability. To the maximum extent permitted by applicable law, Eksire shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, arising out of or in connection with your use of the service. Nothing in these terms limits liability that cannot be limited under applicable law, including mandatory consumer protections.

7. Governing law

These terms are governed by the laws of Norway. Any dispute arising from or relating to these terms or your use of Flagchase shall be subject to the exclusive jurisdiction of the Norwegian courts, with Oslo District Court as the agreed legal venue, unless mandatory law provides otherwise.

8. Account termination

You may delete your account at any time in the app under Profile → Delete Account. We may suspend or terminate your account if you violate these terms, with or without notice depending on the severity of the violation. Upon termination, your personal data is handled as described in our Privacy Policy.

9. Changes and contact
